PLEASE READ THESE TERMS OF USE ("TERMS") BEFORE USING THIS SITE. IF YOU, THE USER, DO NOT AGREE TO THESE TERMS OF USE, PLEASE DO NOT USE THE SITE. ONLY USERS WHO ACCEPT THE FULL TERMS OF USE CAN TAKE ADVANTAGE OF THE SITE, THE SERVICES, OR THE MATERIALS WITHIN.
By viewing or using the Site or any Materials contained within, you agree to be bound by the terms of this document, as well as the Terms of the 360Ed privacy policy found at burncenter.360ed.com/privacypolicy.
360Ed may update this agreement in the future. Please consult this page for the most current version before relying on any of the provisions in this agreement.
Terms
The 360Ed web Site (the "Site") consists of Materials (the "Materials") provided by 360Ed Inc. ("360Ed") and information provided by 360Ed and third parties ("Information Providers") which may be accessed over the Site. These Terms constitute the entire and only agreement (the "Agreement") between 360Ed and the individual that has registered with 360Ed to use the Site (the "User") and supersede all other communications and agreements with regard to the subject matter hereof. 360Ed may, in its sole and absolute discretion, change these Terms from time to time. Such changes shall be posted on the Site.
360Ed Ownership
The Site, services, and Materials contained within are property of 360Ed Incorporated or third parties and are protected by copyright, trademark, and other intellectual and proprietary rights. No ownership is transferred to you by virtue of this agreement or by 360Ed's permitting you to use the Site.

Supply and Delivery
Upon purchase of Burn Center™ Registration Codes ("Codes"), the Codes will be immediately available for viewing and printing. In addition, 360Ed will send a copy of the receipt containing the Burn Center Registration Codes to the email address provided on the order form. You are responsible for recording and maintaining the Codes for your records. However, if you fail to record your Codes, upon notification to 360Ed, 360Ed shall timely send the Codes via email.
Once a registration code is used to register a User on the Site, all Burn Center™ content is accessible. The training videos can be streamed to Users through the Site, and the game can be downloaded.
Refunds
Each registration Code can be used only once, and registration Codes are non-refundable, in whole or in part, once they have been used to register a User. 360Ed shall not be responsible for any unauthorized Site use or Code registrations stemming from lost or stolen Codes. If extra Codes are purchased through some error of the User or Site, please contact esand@360ed.com. You are responsible for reviewing the charges and timely notifying 360Ed of any error. Failure to report charges in error within 30 days means that you accept the charges and that there is not an error. 360Ed reserves the right to change is fees, charge, and billing methods at any time.
Your Obligations
360Ed reserves all rights to the Site, services, and Materials within. You may not: (A) use or transmit any Materials on any other web Site or network, (B) modify, reverse engineer, decompile, or create derivative works, (C) reproduce any Materials, (D) distribute, license, rent, sell, lease or otherwise transfer any Materials, or (E) remove or alter any copyright or trademark on any Materials.
You represent that: (A) you will comply with all laws in the use of this Site, (B) you are not located in or a resident of any country to which export of any Materials is prohibited, (C) you will not upload any malicious data or code or infringe on any intellectual property right.
DISCLAIMER
THE USER EXPRESSLY AGREES THAT USE OF THE SITE IS AT THE USER'S SOLE RISK . NEITHER 360ED NOR ANY OF ITS INFORMATION PROVIDERS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SITE. THE SITE IS PROVIDED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF QUALITY, PERFORMANCE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. 360ED MAKES NO WARRANTY THAT THE SITE WILL MEET YOUR REQUIREMENTS OR THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE OR THAT DEFECTS IN THE SITE WILL BE CORRECTED. NEITHER 360ED NOR ANYONE ELSE INVOLVED IN CREATING, PRODUCING OR DELIVERING THE SITE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SITE OR INABILITY TO USE THE SITE. THE USER EXPRESSLY ACKNOWLEDGES THAT THE PROVISIONS OF THIS SECTION SHALL ALSO APPLY TO THE THIRD PARTY INFORMATION. THE USER AGREES TO INDEMNIFY 360ED AGAINST LIABILITY FOR ANY AND ALL USE OF THE USER'S 360ED ACCOUNT.
Limitation of Liability
IN NO EVENT WILL 360ED BE LIABLE, WHETHER IN CONTRACT OR WARRANTY, TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES ARISING FROM ANY USE OR CONNECTION WITH THIS SITE, ITS SERVICES, OR THE MATERIALS WITHIN (INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM LOSS OF REVENUES, LOST PROFITS, LOSS OF GOODWILL, LOSS OF USE, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES), EVEN IF 360ED HAS BEEN ADVISED (OR SHOULD HAVE KNOWN) OF THE POSSIBILITY OF SUCH DAMAGES.
Applicable Law
By using the Site, the User agrees that the laws of the state of Florida, without regard to principles of conflict of laws, will govern these Terms of Use and any disputes that may arise between the User and 360Ed.
Miscellaneous
If any provision of this agreement is deemed unenforceable or unlawful, it shall be narrowed in scope or amended to reflect the original intent of the parties as expressed in this agreement. If such amendment is impossible, the provision shall be removed from the agreement.
